What is the case? 

The lawsuit was brought by six former employees of Michael Bianco and Front Line Defense.  The employees claimed that the company failed to pay workers properly for overtime hours (hours more than 40 per week).  Employees were paid for the evening hours with checks from Front Line Defense, even though they were often doing the exact same work as they did during the day shift, when they were paid with checks from Michael Bianco.  The employees also claimed that the company illegally deducted wages from their pay when they clocked in only one or two minutes late but had 15 or 30 minutes’ wages deducted from their pay. Back to the top

Has the case been resolved? 

Yes, the case has been resolved through a negotiated settlement agreement.  The company has agreed to pay a total of $850,000 to settle the case.  Back to the top

Who will get payments as a result of the settlement? 

All individuals who worked for Michael Bianco and/or Front Line Defense between 2004 and March 6, 2007, will be eligible for payments from the settlement.  Employees who worked double shifts without receiving overtime pay (or “time-and-a-half”) for hours over 40 per week will receive the largest payments.  The size of the individual payments will depend on how many hours the employee worked.  Employees who did not work double shifts will also receive payments because of the deductions for clocking in late; however, these payments will be significantly smaller.  Some employees who worked for very short periods of time may not get payments. Back to the top

Yes!  Everyone who is entitled to a payment will be able to claim it and have it sent to them, even if they are not currently in the United States.

All former Michael Bianco workers will be able to receive payments regardless of their immigration status.  All personal information is completely confidential and will not be shared with anyone outside Greater Boston Legal Services. Back to the top

When will the payments be available? 

We don’t yet have a precise date when the payments will be distributed, although we hope that it will be before the end of the year.  We will be able to get payments more quickly for workers who call Greater Boston Legal Services soon.Back to the top
